A man who withdrew Ksh. 39,000 from the total received sum of Ksh. 60,000 via M-Pesa has been charged with the offence of stealing contrary to Section 268 the Penal Code.
The particulars of the case is that on June 22, 2019 Stanely Irungu received Ksh. 60,000 in his M-pesa account. The money was deposited by businesswoman, Milicent Atieno who operates an M-Pesa shop at Umoja area in Nairobi county.
The money is said to have been given to Millicent Atieno by a customer to deposit in her number. However, Millicent mistakenly sent it to Irungu’s M-pesa account. Irungu was also her customer. She testified that she tried to reach the accused to return the money but he ignored her call.
It is then that the complainant took up the matter to the police who tracked, found and apprehended the accused.
Appearing before the Makadara Senior Principal Magistrate, Angelo Kithinji, the accused confessed and admitted of receiving the money and withdrawing some of it.
In his mitigation the accused stated that he was ready and willing to pay the complainant back her money.
The magistrate released him on Ksh. 20,000 bail and put the mention date for the case on October 1, 2019.
