– Murgor alleged Patrick Muiruri insulted him using the F word and threatened him with undisclosed consequences
– The senior counsel claimed trouble started when he asked Muiruri’s daughter to step away from the Jewish Cemetery
– Muiruri then allegedly started charging towards him while shouting and hurling insults and had to be restrained by other lawyers
Sarah Wairimu’s lawyer Philip Murgor has lodged complaint against one of the late Tob Cohen’s friends Patrick Kariuki Muiruri claiming he insulted him during burial of the late Dutch tycoon.
Murgor alleged Muiruri also threatened him with unspecified consequences and all because he requested the former Gatundu North MP’s daughter to move away from the Jewish Cemetery where Cohen was being laid to rest on Tuesday, September 24.
In his detailed complaint letter written to the OCS-Parklands Police Station, Murgor alleged Muiruri insulted him using the F word and also said he was going to “deal with him” after the funeral service.
“On September 24, 2019, at the funeral of the late Tob Cohen, I was confronted by one Patrick Muiruri, a Kiambu politician who menacingly shouted at me not to pick on his daughter, but on him if I wanted a confrontation. I had politely requested the daughter of Muiruri to leave the cemetery, as the funeral was agreed to be a private ceremony for family only.Thereafter, he insulted me in the following words ‘f**k you’ and shouted, ‘I will deal with you outside,” the letter read.
The senior counsel further claimed Muiruri was charging towards him as if he also wanted to assault him and that the former legislator had to be restrained by other lawyers, Chege Kirundi, and Mr Cliff Ombeta, who were standing nearby.
“As he advanced towards me, he was restrained by Mr Chege Kirundi, and Mr Cliff Ombeta – advocates who luckily were on hand. The incident was witnessed by George Ouma, an advocate. Given the unexplained leading role, interest and positions taken publicly by Mr Muiruri in the case facing my client Mrs Sarah Cohen, I take this outburst as a threat in an attempt to intimidate me as an advocate for Mrs Cohen,” Murgor alleged.
Muiruri was among close friends and relatives who were present during the burial of Cohen who was laid to rest at the Jewish Cemetery in Nairobi, strictly in line with the Jewish customs which requires that the ceremony be presided over by 10 priests and a Rabbi, among other things.
Also present were Cohen’s widow Wairimu who was granted permission by court to attend the burial ceremony, Cohen’s brother Benard Cohen, President Uhuru Kenyatta’s uncle Ngengi Muigai and his wife Rtd Captain Kungu Muigai, and former Uchumi CEO Jonathan Ciano.
Conspicuously absent, however, was Cohen’s sister Gabrielle van Straten.
She flew out of the country on September 21, together with her husband Roy, a day after opening of her brother’s will in which the widow, Wairimu, was left with nothing.
The prosecution believes Wairimu had a hand in the cruel murder of the 71-year-old businessman whose body was found hidden in a septic tank at their Kitusuru home.
She is expected to appear in court on September 26, 2019, to take plea.
